The Creditors' Rights and Bankruptcy Department combines the experience of the firm's foreclosure, bankruptcy, workout, real estate and litigation attorneys.
The Department represents creditors in all aspects of litigation. Our clients include local and national lenders, banks, insurers and other creditors with respect to their foreclosure, bankruptcy, eviction, REO and collection needs. Often confronting debtor bankruptcies, we are prepared to pursue our clients' rights through litigation in the bankruptcy courts, including Motions for Relief from Stay, adversary proceedings, preference actions, and determination of dischargeability of certain debts. We have conducted over 1000 residential and commercial foreclosures. We streamline the foreclosure process by rapidly resolving title issues and other impediments to foreclosure.
The Department also handles a variety of creditor litigation related to consumer and commercial debt, utilizing prejudgment and post judgment remedies to secure and obtain payment of judgments.
We represent institutional lenders in the enforcement and restructuring of loan and credit obligations, advising clients on issues relating to restructuring debt, including deferred payment schedules and forbearance agreements, securing additional collateral and the liquidation of existing collateral through secured party sales or receivership proceedings.
